CYERA AVATAR GENERATION TERMS OF USE

These Terms of Use (the “Terms”) govern your access to and use of Cyera US, Inc’s (“Cyera”) Avatar generation offering (“Avatar Generation”).  These Terms include by reference Cyera’s Privacy Policy.

  1. Consent. The image you upload will be saved by Cyera and Cyera’s third party vendors to create your Cyera avatar. Please only upload photos that you have the rights to the image to and you grant Cyera and Cyera’s third party vendors permission to use it to generate your Cyera avatar.
  2. AI Processing. Cyera is using AI to create your Cyera avatar. Given the nature of AI unintended modifications or inaccuracies may result.
  3. Privacy. Information related to how we collect, process, and use the personal information you submit to Cyera as part of the Avatar Generation is included in Cyera’s Privacy Policy.  By accessing and using the Avatar Generation, you allow Cyera to disclose your personal information to Cyera’s third party vendors.
  4. Marketing. By participating in the Avatar Generation, you give Cyera permission to (i) use your Cyera avatar on our website and other marketing materials and (ii) use any contact information you submit through the Avatar Generation to send you marketing communications, promotional materials, and updates about our products and services.
  5. Disclaimer. Cyera provides the Cyera avatar without any warranties of any kind.
  6. Limitation of Liability. Cyera’s maximum aggregate liability for all damages, losses, cause of action in connection with the Avatar Generation shall be limited to the fees paid for the avatar generation. 
  7. Miscellaneous. Cyera reserves the right to modify or amend these Terms at any time in Cyera’s sole discretion.  Your access to the Avatar Generation will constitute your acceptance of the revised Terms.  These Terms do not confer any rights to any third party.  These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of laws rules.  The exclusive venue and jurisdiction for any and all disputes, claims and controversies arising from or relating to these Terms shall be the state or federal courts located in Wilmington, Delaware.  In the event that any provision of these Terms conflicts with governing law or if any provision is held to be null, void or otherwise ineffective or invalid by a court of competent jurisdiction, the remaining terms, provisions, covenants and restrictions of these Terms shall remain in full force and effect.  No waiver of any breach of any provision of these Terms shall constitute any prior waiver, and no waiver shall be effective unless made in writing and signed by an authorized representative of the waiving party.  These Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior and contemporaneous agreements or communications with respect to the subject matter hereof.
